NFIB Fights Big Labor on Card Checks
01/30/2007

Legislation could shut small business out of employees' decision to unionize
As labor unions pursue legislation that would forego the traditional secret ballot for card checks, small-business owners could find themselves effectively shut out of the process as their employees decide whether to unionize.

Current law allows a business to voluntarily recognize card checks, a method that unionizes employees if a majority signs authorization cards, though they may opt to use the traditional secret ballot instead. However, NFIB expects Congress to introduce federal legislation known as the Employee Free Choice Act this spring. This legislation will allow labor unions to choose the card-check method, leaving the small-business owner out of the process and achieving recognition in as few as 60 days.

NFIB believes that to ensure employees are given a true choice, they should be allowed to vote in a private voting booth where they aren't subject to potential intimidation, harassment or other coercive tactics used by union organizers. The election process also provides companies a six-month period to discuss with their employees why they shouldn't join a union.

NFIB will continue to fight for the rights of small-business owners and their employees, and urges you to contact your lawmakers and tell them to oppose the Employee Free Choice Act.
